The RAF provides compensation to the users of South African roads when injuries are sustained, or death occurs arising from accidents involving motor vehicles. Claims against the RAF can be lodged by either the person injured or, if they are not able to due to their injuries or if they are deceased, by their families.
If you were injured, suffered a loss, or were deceased due to a motor vehicle accident, you or your family may have a claim against the RAF.
You may have a claim from the RAF if you were injured in a motor vehicle accident, whether you were a driver, passenger, pedestrian, cyclist, or motorcyclist. Similarly, if you are deceased, your family may have a claim. Claims may be proportioned depending on your responsibility with respect to the cause of the accident.
Unfortunately, the claims process can be complicated depending on the circumstances of the accident, and normally takes a long time from inception to payment. However, claims are eventually paid. The RAF makes payments to claimants of close to R40 billion a year.
In April 2011, a 12-year-old minor was involved in a motor vehicle accident near Sebokeng. In 2020 the RAF paid her an amount of R7.2m for general damages, future loss of earnings and undertook to cover her future medical expenses. Due to her severe traumatic brain injury, she could no longer pursue a career as a paralegal and only managed to complete her Grade 12 with intensive remedial assistance. She is now employed in a protective working environment.
